Terms of Service

Last updated: April 24, 2026

These Terms of Service (“Terms”) govern your use of the website at makologics.com (the “Site”), operated by Mako Logics LLC (“Mako,” “we,” “us”), a Texas limited liability company headquartered at 550 Club Dr #264, Montgomery, TX 77316.

By accessing or using the Site, you agree to these Terms. If you don’t agree, don’t use the Site.

These Terms cover use of the website only. Paid services that Mako provides to managed clients — managed IT, cybersecurity, colocation, professional services, and any other commercial engagement — are governed by a separately signed Master Services Agreement (MSA) and any Statement of Work (SOW), Business Associate Agreement (BAA), or other instruments referenced in the MSA. Where these Terms and a signed MSA conflict, the MSA controls for that client.

1. Who can use the Site

The Site is a business information resource directed at U.S. companies and professionals evaluating managed IT providers. You must be at least 18 years old and authorized to act on behalf of any organization you represent when using the Site. The Site is not directed at children under 13.

2. What you can do on the Site

You’re welcome to:

  • Browse our services, industries, resources, and blog.
  • Download or print our resource guides for your own business use, including internal distribution within your company.
  • Quote short excerpts of our content with attribution and a link back to the source page.
  • Contact us through the contact form, email, or phone about services or potential engagements.

3. What you can’t do on the Site

You agree not to, and not to let anyone on your behalf:

  • Republish or mirror substantial portions of the Site without our written permission.
  • Scrape, crawl, or harvest content, email addresses, or phone numbers from the Site for marketing, resale, or training of AI models.
  • Attempt to probe, scan, or test the security of the Site or its infrastructure without prior written authorization. Responsible-disclosure reports are welcome — see our security.txt.
  • Upload or submit malware, illegal content, content that infringes someone else’s rights, or spam.
  • Use the Site to harass, defame, or threaten any person or organization.
  • Misrepresent your identity or affiliation in any communication with us, including contact-form submissions.
  • Interfere with the Site’s operation — for example, running denial-of-service traffic against it or exploiting vulnerabilities.

4. Our content, methodology, and trademarks

Copyright. All text, graphics, photography, video, code, page layouts, and other content on the Site is © 2026 Mako Logics LLC or its licensors. All rights reserved. “Mako Logics,” “Mako,” and the Mako logo are trademarks of Mako Logics LLC. Third-party trademarks shown on the Site (Microsoft, Cisco, CompTIA, partner logos, client logos, and similar marks) are the property of their respective owners and appear for identification and factual reference only.

What specifically is protected. Without limiting the generality of the preceding paragraph, the following items are protected as Mako’s original work and may not be republished, paraphrased, copied into another provider’s marketing, or incorporated into a derivative work without prior written permission:

  • Published pricing structure, tier names, itemized stack disclosures, and the bundled-vs-pass-through framing on our pricing page.
  • Original research and survey data, including but not limited to the April 2026 Houston-MSP pricing-transparency audit and any successor audits.
  • Industry, service, and area pages — including pain-point lists, comparison tables, and FAQ answers authored by Mako.
  • The pricing calculator’s interaction model, field labels, breakdown structure, and the specific rates shown within it.
  • Case studies, client stories, the Bunker tour content, and photography of our facility, staff, and client sites.
  • Resource guides, checklists, templates, and any PDF or document downloads made available through the Site.

What you may do.You may view the Site in a standard web browser, print or save pages for your own business’s internal reference, and quote short excerpts (roughly a paragraph or less) with clear attribution to Mako Logics and a working link back to the source page.

What requires written permission. Everything else, including: (a) republishing or mirroring substantial portions of the Site elsewhere; (b) incorporating our content, research, or methodology into a competing MSP, consulting, or marketing product; (c) training, fine-tuning, or evaluating generative AI models on our text; (d) using our pricing page content to seed or populate a competing pricing or comparison tool; (e) producing printed or digital derivative works based on our content; and (f) reproducing our photography, logos, or design system outside of fair-use commentary.

To request permission, email support@makologics.com with the specific content you want to use, the audience or publication, and the context. We respond to legitimate permission requests; we decline the ones that look like republishing-for-resale.

Copyright infringement notices (DMCA). If you believe content on the Site infringes your copyright, or if you find Mako content republished without our permission and want to report it to us, send written notice to support@makologics.com including: the copyrighted work, the URL where the infringing material appears, your contact information, a good-faith statement that the use is not authorized, and a statement under penalty of perjury that the information in the notice is accurate. We respond to complete notices promptly.

5. Information you submit

When you contact us through the Site, you’re asking us to respond to an inquiry. We handle the information you provide under our Privacy Policy.

Don’t submit confidential information through the website contact form. If you need to share sensitive details (passwords, production credentials, regulated data, legally privileged material), wait until we’ve set up an appropriate secure channel under a signed agreement.

6. Links to third-party sites

The Site links to third-party sites (vendors we partner with, public resources, industry references). We don’t control those sites, we’re not responsible for their content or practices, and a link from our Site isn’t an endorsement. Read each third party’s terms and privacy policy before using their service.

7. No warranty on the Site

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including any warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We work to keep the Site accurate and current, but pricing ranges, technical references, compliance summaries, and similar content are informational — not professional, legal, or regulatory advice.

Nothing in this Section 7 limits warranties Mako has agreed to in a signed Master Services Agreement. Those warranties, if any, apply to our paid services, not to the Site.

8. Limitation of liability

To the maximum extent permitted by law, Mako Logics LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages — including lost profits, lost data, or business interruption — arising out of your use of the Site, even if we’ve been advised of the possibility of those damages.

Our total liability to you for any claim arising out of your use of the Site is limited to one hundred U.S. dollars (US $100). This Section 8 applies only to the Site; liability under a signed Master Services Agreement is governed by that MSA.

9. Indemnification

If your use of the Site causes a third party to bring a claim against us — for example, because you scraped our content, misrepresented yourself, or used the Site to violate another party’s rights — you’ll defend, indemnify, and hold harmless Mako Logics LLC and its owners, employees, and contractors from that claim, including reasonable legal fees.

10. Relationship between these Terms and a signed MSA

If you are a current or former Mako managed client, these Terms apply to your use of the website. The commercial services Mako provides to you under a signed MSA — including service scope, fees, term length, auto-renewal, cancellation, SLA, warranty, liability caps, and data handling — are governed by that MSA and any Statement of Work, Business Associate Agreement, or similar instrument executed under it. If these Terms and a signed MSA conflict, the MSA controls for that client.

11. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Montgomery County, Texas, and you consent to the jurisdiction of those courts.

Before filing a lawsuit, both you and Mako agree to try to resolve any dispute informally by email — send the claim, the relief you’re seeking, and your contact information to support@makologics.com and give us thirty (30) days to respond.

12. Changes to these Terms

We may update these Terms as the Site evolves or as legal requirements change. When we make material changes, we’ll update the “Last updated” date at the top of this page and — for significant changes — post a notice on the Site. Your continued use of the Site after an update means you accept the updated Terms.

13. Severability and entire agreement

If any part of these Terms is found unenforceable, the rest of the Terms will remain in effect. These Terms, along with our Privacy Policy and any document they link to, are the entire agreement between you and Mako Logics LLC regarding your use of the Site, and they replace any prior understanding on that subject. They do not affect the terms of any signed MSA between you and Mako.
